What’s the difference between a misdemeanor and a felony?

A misdemeanor is a less serious crime, typically punishable by up to one year in jail and/or fines. A felony is more serious and can result in prison time exceeding one year, larger fines, and long-term consequences like loss of civil rights and job restrictions.

Am I required to take a breathalyzer test in Indiana?

Under Indiana’s implied consent law, if you’re lawfully arrested for DUI (called Operating While Intoxicated, or OWI), you are required to submit to a certified chemical test. Refusal can result in a one-year license suspension for first offenses, and two years for subsequent refusals, regardless of whether you’re convicted in court.

What are the penalties for a first OWI offense in Indiana?

A first-time OWI in Indiana is typically a Class C misdemeanor, punishable by up to 60 days in jail, a fine up to $500, and a license suspension of up to 2 years. Penalties increase with aggravating factors such as a BAC of 0.15% or higher, accidents, or minors in the vehicle.
